Terms and Conditions MANDATORY WAIVER, RELEASE AND INDEMNITY AGREEMENT For and in consideration of Taylor Mehlhaff Kicking LLC and any and all sponsors, coaches, volunteers, affiliates and other individuals or groups associated with Taylor Mehlhaff Kicking LLC including the Board of Regents of the facility the camp is held at, its officers, employees and agents permitting Participant to participate in the selected Kicking Camp. Participant, by agreeing to these terms, hereby voluntarily indemnifies, releases from liability and holds harmless all Camp Sponsors for any accident, injury, illness, death, loss, damage to person or property, or other consequences suffered by Participant or any other person arising or resulting directly or indirectly from Participant’s participation in the Taylor Mehlhaff Kicking Camp. In the event that Participant is injured, Participant agrees to assume any financial obligation, either through Participant’s personal health insurance, or through some other means, for any medical costs which Participant incurs. Camp Sponsors assume no responsibility for any medical expenses, injury, or damage suffered by Participant in connection with Participant’s participation in the Taylor Mehlhaff Kicking Camp. Participant further agrees to conform to all rules and regulations adopted by Camp Sponsors relating to the Taylor Mehlhaff Kicking Camp. IT IS THE INTENTION OF PARTICIPANT BY AGREEING TO THESE TERMS TO EXPRESSLY ASSUME ALL RISK OF PERSONAL INJURY, DEATH, OR PROPERTY DAMAGE UPON HIM/HERSELF, TO THE EXCLUSION OF CAMP SPONSORS, AND TO EXEMPT AND RELIEVE ALL CAMP SPONSORS FROM LIABILITY FOR PERSONAL INJURY, PROPERTY DAMAGE OR WRONGFUL DEATH. Participant further agrees that Participant, his/her parents, assignees, heirs, guardians, and legal representatives will not make any claim against, sue or attach the property of Camp Sponsors for any loss or damage resulting from Participant’s participation in the Taylor Mehlhaff Kicking Camp. PARTICIPANT IS AWARE OF THE POTENTIAL DANGERS INCIDENTAL TO ENGAGING IN THIS ACTIVITY, THAT THIS IS A RELEASE OF LIABILITY, A WAIVER OF THE PARTICIPANT’S LEGAL RIGHT TO COLLECT DAMAGES IN THE EVENT OF INJURY, DEATH OR PROPERTY DAMAGE AND A CONTRACT BETWEEN PARTICIPANT AND CAMP SPONSORS, AND PARTICIPANT SIGNS IT OF HIS/HER OWN FREE WILL. PROMOTIONAL VIDEO AGREEMENT By agreeing to these terms, Participant gives full permission for the use of his/her name, picture, likeness, actions, voice, or other personally identifiable information, in whole or in part, individually or in conjunction with other images, as part of a video promoting Taylor Mehlhaff Kicking Camps. Participant waives all rights of privacy or compensation, which may have in connection with such use of his/her name, picture, image, likeness, actions, voice or other personally identifiable information. He/she grants Taylor Mehlhaff Kicking Camp and its officials, employees, representatives, agents, licensees, successors and assignees the irrevocable and unrestricted right us use his/her name, picture, image, likeness, actions, voice or other personally identifiable information associated with such video submission in all formats, media and in all manners, including composite or altered representations, for advertising, trade or any other lawful purposes. Participant waives any right to inspect or approve the finished version(s), including written copy that may be created in connection with the video production, editing and promotion therewith. By checking ‘Agree’, Participant (18 years or older) or guardian agrees that he/she has read this release and is fully familiar with its contents.
